In Mediation, do you represent either party?

Are Attorneys allowed to attend Private mediation?
The presence of attorneys in private mediation is not allowed. It creates unnecessary problems and can create power imbalances as well as issues with confidentiality and conflicts of interest.
Can we still go to Court after mediation if needed?
Yes, mediation is a voluntary process. If a resolution is not reached through mediation, or if circumstances change, you retain the right to pursue litigation or other legal avenues outside of mediation.
Do both parties need to agree to mediation?
Yes, both parties should agree to participate in mediation for it to be most effective. However, one party can initiate the process, and the mediator can reach out to the other party to explain the benefits of mediation and determine if they are in agreement or not.
